These terms apply to you if you are buying an item from someone's personal store on Downsizr. They sit alongside our general terms of service and privacy policy, which also apply to you as a Downsizr user. Where these terms and the general terms differ on a point about buying from a personal store, these terms apply

Where these terms and our returns and refunds policy differ about a return or a refund, the returns and refunds policy is the authority

1. What these terms cover

A personal store is a collection of items that one person – the owner – is selling from their own home. These terms cover what happens when you buy one of those items

By using Downsizr you are already bound by our general terms of service. These buyer terms add to them; they describe the things that are specific to buying from a personal store, and they do not replace anything in the general terms except where they say so above

2. Who you are buying from

You are buying from the owner, not from Downsizr. The owner is a private individual selling their own possessions. Downsizr provides the platform and collects the payment, and is not the seller and not a party to your contract for the goods

Downsizr collects your payment as the owner's limited commercial agent. That matters in your favour: when you pay us, your obligation to pay the owner is discharged at that moment. If anything then goes wrong between us and the owner about passing the money on, that is a matter between us and the owner, and you do not have to pay twice

3. What appears on your statement

For the item itself, your card statement will show the owner's own name, not Downsizr's. This is deliberate – you are buying from that person, and your statement should say so

If we cannot derive a usable name for an owner, that owner cannot take payment at all until it is resolved. The item itself never appears on your statement as a purchase from Downsizr. Postage is different: where you pay for postage, it is a separate charge made by Downsizr, and it appears in Downsizr's name

4. Condition and description

Items in a personal store are pre-owned personal possessions. The owner describes them in good faith, but neither the owner nor Downsizr gives any warranty about an item's condition, value or fitness for any purpose

Nothing in these terms affects the statutory rights you have, which are described in section 24 of our general terms of service

5. Wording drafted with our AI tools

Owners may use our AI tools to help draft an item's title and description. These tools are assistive: they suggest wording from the owner's own photographs and notes, and the owner remains responsible for the accuracy of what is published

Wording produced this way is not a warranty, an appraisal or a valuation, by the owner or by Downsizr. If a description matters to your decision to buy, ask the owner before you buy rather than after

6. Postage

Where you choose to have an item posted, checkout may ask you to agree that postage can be charged to your card later, up to a maximum amount. We call that maximum the ceiling

Where postage is charged separately, it is charged under the ceiling and in the wording you agreed at checkout. We store that wording exactly as it was shown to you, so what you agreed is what applies, and a later change to our standard wording does not change your order

How postage is charged

Postage is a separate charge made by Downsizr, not by the seller. We take it after the payment for the item, once the shipping cost is known, from the card you used at checkout

When we take postage from your card without asking you again, we never take more than the ceiling. If postage costs more than the ceiling, we either take the ceiling and cover the difference ourselves, or take nothing. We also take nothing if the charge to your card does not go through, for example because your bank asks you to approve it

Where we take nothing, the seller may contact you to arrange payment for the postage, and your order page may ask you to pay it. That amount is the postage price for your parcel at the time you pay and can be more than the ceiling. Paying it is your choice, but we do not book postage for your item until it is paid

7. Cancelling, and what your rights are here

You are buying from a private individual rather than from a business, and that affects one particular right

The fourteen-day right to cancel a distance contract and change your mind, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, applies to purchases made from a trader. A private individual selling their own used possessions is not normally a trader, so that right will not usually apply to a purchase from a personal store. Downsizr taking a commission and handling the payment does not make Downsizr the seller

This does not leave you without rights. It is the change-of-mind right that does not normally apply. If an item never arrives, or is materially not what it was described to be, that is a different matter and section 8 below tells you what to do

Nothing in these terms takes away any statutory right you do have. Section 24 of our general terms of service sets those out, and section 24.2 provides that where anything in our terms conflicts with your statutory rights, your statutory rights prevail

8. If something goes wrong

Write to us at support@downsizr.com. We will acknowledge you within two working days and respond within fifteen working days. This is the route for a buyer in a personal store, and it is set out in section 25.1 of our general terms of service

Tell us what you bought, what has happened and what you would like done. We will look at it and talk to the owner. Where a refund is due, our support team issues it on the seller's behalf

Some postage refunds are a right, not something at our discretion. If an item never arrives and cannot be found, you are refunded in full, including any postage you paid. Where the whole order is refunded, for whatever reason, including an item that was materially not as described, the refund includes the postage you paid on it

Where one item out of several is returned, our returns and refunds policy explains what happens to the postage, because it depends on how the order was sent. That policy also sets out who pays to send an item back

Where postage has been charged and something else has gone wrong with it, we may refund the postage at our discretion once you have contacted us. That is a discretion we exercise after looking at what happened; it is not something you can trigger yourself, and it covers the postage rather than the item

9. Your information

We hold and use your information as described in our privacy policy, which covers what we hold when you buy from a personal store, who we share it with and how long we keep it

10. Governing law

These terms, and any dispute arising from or in connection with them, are governed by the laws of England and Wales. If you are a consumer in the United States, nothing in these terms takes away protections you have under laws that apply to you and cannot be waived, including, for California residents, the Consumers Legal Remedies Act

11. Questions

If anything here is unclear, or something has gone wrong with a purchase, write to us at support@downsizr.com and we will help

12. Making an offer

Where a seller accepts offers, you can offer less than the asking price for an item. An offer stays open until the deadline shown when you make it, which is never more than 48 hours. A seller cannot accept it after that deadline

Making an offer does not charge your card. If the seller accepts your offer, we take the payment at that point from the card you gave with it. If that payment does not go through, nothing is sold and the offer stays open until its deadline

Where a seller has chosen to accept offers automatically, an offer at or above the level they set may be accepted as soon as you make it

13. Checking out

Starting a checkout does not reserve an item. If another buyer pays for it first, it is theirs

If an item in your order cannot be supplied when your payment is processed, for example because another buyer paid for it first, you are refunded for that item

If the seller changes the price of an item after you start a checkout but before the payment step opens, we cancel that checkout. You can then start again at the new price

Where you check out as a guest, we keep an account record for you using the name and email address you give us. The link we give you to pay for a guest order lasts 60 minutes

If you are signed in, you can choose at checkout to save your card. Saving it is optional, and we will remove it if you ask

14. Delivery, collection and receipt

Items in a personal store are located in the UK or the US. Checkout shows the countries an item can be delivered to

Where a seller offers collection and you choose to collect, we show you the seller's address for that order. We do not show you a seller's address for an order that is posted to you

Confirming receipt tells us that the item arrived
