These terms apply to you if someone has offered you an item as a gift through Downsizr. They sit alongside our general terms of service and privacy policy, which also apply to you as a Downsizr user. Where these terms and the general terms differ on a point about gifts, these terms apply

1. What being a giftee means

A giftee is someone an item's owner has chosen to receive that item at no cost. You do not buy anything, you do not bid, and you never pay Downsizr anything to receive a gift

Downsizr provides the platform through which the offer, your decision and the handover are arranged. The gift itself is between you and the owner. Downsizr is not a party to the gift

2. Receiving an offer

When an owner offers you an item, we send you an invitation by email. If you do not yet have a Downsizr account, the invitation includes a secure link to create one

Each offer stays open for seven days from the moment it is sent. If you have not responded by then, the offer lapses and the item returns to the owner. A lapsed offer is not a rejection on your part, and the owner may choose to offer the item to you again

An owner may offer the same item to several people at once. Where they do, the first person to accept receives the item, and the offer closes for everyone else. We will tell you if an item you were considering has been claimed by someone else

3. What it costs you

Nothing. There is no charge to you for receiving a gift through Downsizr

If the item is shipped to you, the owner arranges and pays for the shipping, including any carrier charges and Downsizr's handling charge. The full cost is shown to the owner before they confirm the booking. You will never be asked for payment details, and Downsizr holds no payment information about you as a giftee

4. Accepting or declining

You may accept or decline each offer, and you may add a short message with your decision. Your decision is final for that offer: once you have accepted or declined, you cannot change your response. If you decline, the owner is free to offer the item to someone else or to do something else with it

Declining is always fine. Owners offer items because they hope they will be wanted, not to create an obligation. A polite no helps them move on to their next choice

5. Choosing how to receive your gift

Once you accept, we ask how you would like to receive the item. You can choose

  • quick pickup – you collect the item from the owner soon, at a time you arrange between you
  • pickup later – you collect the item from the owner at a later date
  • delivery by the owner – the owner brings the item to an address you provide
  • shipping – the item is sent to you by a courier arranged and paid for by the owner

If you choose delivery or shipping, we need a delivery address from you. You can provide a new address or choose one you have saved before

You may change your choice before anything has been booked. If you switch away from shipping before the owner books a courier, any pending shipping arrangements are cancelled automatically. Once a shipment has been paid for and is under way, changes need to be arranged with the owner

6. The owner may withdraw a gift

Occasionally an owner withdraws an item after offering it, and this can happen even after you have accepted, at any point before the item is handed over or dispatched. If that happens we will let you know straight away. We know this can be disappointing, but the item remains the owner's until you receive it, and acceptance of an offer is not a contract of sale or a guarantee of receipt

7. When your gift arrives

If your item is shipped, we will ask you to confirm that it has arrived and to tell us what condition it arrived in. If it arrived damaged, telling us opens a formal record with the courier arrangement straight away, so please report any damage as soon as you notice it. Confirming arrival completes the gift

Items offered as gifts are pre-owned personal possessions. The owner describes them in good faith, but neither the owner nor Downsizr gives any warranty about an item's condition, value or fitness for any purpose. Nothing in these terms affects your statutory rights

8. Your information

We look after your information carefully. As a giftee we hold your name, email address and, if you provide them, your phone number and delivery addresses. Delivery addresses and your personal contact details are encrypted at rest

When you accept a gift and choose delivery or shipping, your name and delivery address are shared with the owner and, for shipped items, with the courier – they need them to get the item to you. The owner sees your name and your decision on each offer. Beyond that, your details are handled as described in our privacy policy

We may send you a short daily summary email when there is activity on your gifts, at most once a day and only when there is something new. You can turn this summary off at any time using the link in the email. Emails about specific offers and deliveries, which you need in order to receive your gifts, are unaffected by that choice

9. Your account

You need a Downsizr account to respond to offers. Our general terms of service govern your account, including the requirement to keep your details accurate and the rule of one account per user type

10. Governing law

These terms, and any dispute arising from or in connection with them, are governed by the laws of England and Wales. If you are a consumer in the United States, nothing in these terms takes away protections you have under laws that apply to you and cannot be waived, including, for California residents, the Consumers Legal Remedies Act
