These terms apply to you if you are selling items from your personal store on Downsizr. They sit alongside our general terms of service and privacy policy, which also apply to you as a Downsizr user. Where these terms and the general terms differ on a point about selling from a personal store, these terms apply

1. What these terms cover

A personal store lets you sell your own possessions directly to a buyer. These terms cover the things that are specific to that, and they add to the general terms of service rather than replacing them

Section 7.1 of the general terms already covers your responsibilities as an owner – that you own what you list, that you are entitled to sell it, that your description is accurate, and that the item is not prohibited. Those apply here and are not repeated

2. You are the seller

The buyer's contract for the goods is with you. Downsizr provides the platform and collects the payment as your limited commercial agent, and is not a party to the sale

One consequence matters to you: when the buyer pays us, their obligation to pay you is discharged at that moment. From then on, getting the money to you is our responsibility to you, not the buyer's

Getting paid

You are paid out after the sale, either automatically or after a review by our staff

Where the buyer chose postage and, seven days after payment, no shipment has been booked through Downsizr, our staff may review the sale before you are paid

If an item cannot be supplied when the buyer's payment is processed, for example because another buyer paid for it first, Downsizr refunds the buyer for that item. It also reverses the payment to you for that item and does not keep its commission on it

3. You cannot take payment until we can derive a name to show the buyer

A buyer's card statement shows your name, not Downsizr's. We derive that from the name on your account. Postage is different: where the buyer pays for postage, it is a separate charge made by Downsizr, and it appears in Downsizr's name

If we cannot derive a usable name, your store cannot take payment until it is resolved. This is a live precondition in the system rather than a policy we apply by hand – there is no route by which a sale completes with your name missing

4. Your description, including wording drafted with our AI tools

You may use our AI tools to help draft an item's title and description. They are assistive: they suggest wording from your own photographs and notes

You remain responsible for the accuracy of everything published in your store, including wording our tools drafted. Section 7.1(c) of the general terms sets out that responsibility, and using our tools does not move it to us. Read what they produce before you publish it

5. Commission

Our commission on a personal-store sale is set out in section 6.11 of the general terms of service. That section is the single place the rate is stated

6. Dispatching what you sell

Where an item is to be posted, send it promptly once the sale completes, and use the postage arrangement the buyer agreed at checkout

Keep the buyer informed if anything delays you. A buyer who has paid and heard nothing is the most common way a straightforward sale turns into a complaint

Collection

If the buyer chose to collect the item, their order shows them the collection address once they have paid

If you cannot complete a sale

You cannot cancel a paid order yourself. If you cannot complete a sale, write to our support team straight away

7. Selling as a private individual

You are selling your own possessions as a private individual, not as a business. That is what a personal store is for, and it shapes what the buyer can expect

Because of it, the fourteen-day right to change one's mind about a distance purchase, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, does not normally apply to your sales. That right applies to purchases from a trader. Our buyer terms say this to buyers plainly, so they know before they buy

Two things follow, and they matter

If you are in fact trading – buying items in order to resell them, or selling at a scale and regularity that amounts to a business – then you may be a trader in law whatever your store is called, and obligations apply to you that these terms do not describe. Presenting yourself as a private seller when you are actually trading is itself a breach of consumer protection law, and it is not something Downsizr can cure for you. If that might describe you, take your own advice before you list

Selling privately does not mean selling carelessly. You must still describe an item accurately, and a buyer who receives something materially different from what you described has a claim against you regardless of your status

8. If a buyer raises something with us

A buyer who has a problem writes to our support team, and we will come to you to understand what happened. Deal with us promptly when we do

Refunds

Our support team issues refunds on your behalf for an item that was not as described or never arrived. Where you are responsible, you authorise Downsizr to recover the amount from money due to you from later sales, or to ask you to repay it

Holding a payment during a complaint

Where a buyer raises a complaint about one of your personal-store sales, Downsizr may, at its discretion, hold your payment for that sale while the complaint is reviewed. If it does, our support team tells you by email

9. Showing your items on Facebook and Instagram

Showing your store's items on Facebook and Instagram is optional, and it is off unless you turn it on. You turn it on by ticking "Show my items for sale on Facebook and Instagram" on your personal store page. Someone with shared access to your account can also tick it for you, and should do so only if you have agreed. We record who ticked it

While it is ticked, we send Meta Platforms Ireland Limited the title, description, condition, maker or brand, category, price and photos of each item your store is selling, with a link to that item in your store. Your store's web address is your store's name, which is usually your own name. Meta may show these details publicly on Facebook and Instagram. Meta's own terms and policies govern how it shows and uses them, and Downsizr does not control them

A buyer who taps one of your items there comes to your store to buy it. That is a personal-store sale on these terms, and the commission in section 5 applies. There is no separate Facebook or Instagram commission

Your items appear once Downsizr has added your store, usually within a working day. If you untick it, or ask us to close your account, we stop sending your items and they come off Facebook and Instagram, usually within a working day

10. Governing law

These terms, and any dispute arising from or in connection with them, are governed by the laws of England and Wales. If you are a consumer in the United States, nothing in these terms takes away protections you have under laws that apply to you and cannot be waived, including, for California residents, the Consumers Legal Remedies Act

11. Questions

If anything here is unclear, or something has gone wrong with a sale, write to us at support@downsizr.com and we will help
